揭秘投资移民地雷:在美50万投资都不够发工资   本报记者 包慧 上海报道   人民币进入贬值通道之后,国内的移民人数并没有明显增长,宜信财富高级副总裁、好望角咨询总裁詹惠敏对21世纪经济报道记者表示,“因为在中国人移民的影响因素中,汇率的影响比较小。最重要的还是子女教育等方面的考虑。”   而高净值人群全球资产配置一个很重要的制约就是国内的政策管制,因此先移民获得身份,再在海外市场寻找投资机会,成为一种较为普遍的路径,但其中也有些需要注意的风险往往会被忽略。    移民风险“地雷”   多家移民机构人士介绍,美国投资移民EB5项目有两个监管机构,美国移民局和美国的证券交易委员会SEC。EB5看起来似乎很简单,投资50万美金,在美国特定的地区能创造10个就业机会,但美国平均工资是5万美金,要求至少创造两年10个就业机会,50万仅发工资都不够。   这导致,投资人直接来投EB5项目基本不可能,由此,区域中心应运而生。区域中心可把项目区域里创造的间接就业机会算给投资人,其出具的经济学报告还是要移民局审批。   值得注意的是,提供这种服务的区域中心都是私营机构,英文叫regional center,也由美国移民局和SEC来监管。虽没有牌照,但移民局每年都要对区域中心检查。   区域中心是投资移民产品的发行方,而投资人则要自负盈亏。詹惠敏表示,最关键的是借款方。比如房地产项目的借款方是开发商,需要核实开发商背景和相关商业计划书,比如有没有批准在这儿造酒店,银行是不是同意贷款了。第二就是不找新开发商。好望角“猎人角”项目,借款人Lennar公司是美国排名靠前的大型房地产开发商。第三就是发行方区域中心跟借款方开发商之间不能有关联关系,区域中心要有良好信用记录。   “披露越多破绽越多,信息披露完备的项目风险相对小。比如造酒店,说房租收入每天600美金,但周边房租只有300美金,就不合理。”詹惠敏称。   还有从金融角度去考察杠杆和现金流的问题,开发商自己投入的钱占多少。“猎人角”项目开发商自己投了50%,杠杆仅1倍。还要测算其现金流是否有资金链断裂风险。   虽然美国对造假、项目上的违规惩罚非常严厉,在美国投资移民历史上出现过芝加哥会议中心等著名的风险案件。但除了恶意造假外,还有其它经营风险。有的EB5项目实实在在运营,但也会经营不善破产,房地产项目相对于其它经营性投资风险要小。   另据业内人士介绍,中国移民群体还有个特点,就是相信政府,但项目是否拿到政府补助,跟公司运营好不好没必然联系。    “陷阱”怎么形成   在海外投资中,中国人最偏好的是房地产投资。以投资房产为例,信息不对称成为最为常见的“陷阱”,其中最关键的就是贷款和租金等信息。   业内人士介绍,有的房贷产品前三年只还利息,月供就低,但三年以后月供就突然高起来。还有些中介推出保三到五年租金,常见的骗局是本来房价是20万,卖25万,多的5万折算成三年房租返还给投资人。但三年后房子可能租不出去了。   除显性房产税外,在美国投资房产还有其他的隐形费用。买老房子经常需要维修,维修费用很高,还有些房屋财产保险要买。   正在办移民的李玉(化名)对21世纪经济报道记者表示,她在美国买房后才发现美国没有所谓学区房。孩子上公立学校还是要有身份。而且买房过程中没有身份也是处处受限,美国贷款利率低至3%、2%,但为外国人放贷款的公司很少,且利率比美国人高50%。首付美国人只要20%,外国人就是30%-40%。外国人还没有增值税的免税权。在美国买房子还有遗产税,美国永久居民有540万美金的免税额,没有绿卡的从零开始收40%以上遗产税。   除EB5之外,还有通过L1签证转绿卡的骗局。某小企业主王某称,L1签证针对跨国公司在美开设分公司的高管,但移民中介就编造了一个公司,说王某是该公司高管。L1只有一年期,但要转成绿卡还要经过审查,包括是否是真公司,是否在运营,你说是高管,总得雇五六个当地的雇员,实际下来花费反而会高于EB-5。但其优势在于快,只要几个月到半年,EB-5则需一年多至两年时间。    欧洲小国成新宠   21世纪经济报道记者了解到,随着美加澳等传统的移民大国调整政策,提高门槛,欧洲一些小国正在成为新的热门移民目的国,其移民政策相对宽松、办理周期短、福利条件和子女教育等有优势。以葡萄牙为例,申请移民只需在葡萄牙购买50万欧元以上的房产。   葡萄牙等国还可把双方父母也给带上,一家七口可一起移民。有些移民中介将其变成理财产品,不仅帮客户买房子,还有保租金、保回购的条款,变成保本保息的移民金融产品。   葡萄牙等欧洲小国也没有资金来源的审核要求。现在美国移民要查资金来源证明。要查到什么程度?据业内人士介绍,比如说是工资性收入,要提供税单证明,如果是证券交易收入,需提供交割单。但也有规避的办法,比如说在北京、上海就很好做资金来源证明。因为房价高,可以说房产升值来的。   李玉表示,7年前购买的房产不需提供交易记录,7年内要提供,买房子的价格及现在估值间的升值部分就是资金来源,并不需要真的把房子卖掉,可通过银行做虚拟抵押给房产提供估值。   比如李玉在上海有套房子现在估值500万,买入价是100万,升值了400万,即为资金来源的证明。李玉到银行做虚拟抵押,贷出400万来,形式上这400万做投资移民去了,但在资金审查通过后就可以把钱还给银行。(编辑:李伊琳,邮箱:liyil@@21jingji) 进入【新浪财经股吧】讨论相关的主题文章:
